Photography Workshops of Utah – Workshop Liability Waiver & Release
IMPORTANT – PLEASE READ CAREFULLY
By checking the box below and registering for a Photography Workshop or Adventure Trip, you acknowledge and agree to the following:
Assumption of Risk: I understand that participation in photography workshops and adventure trips involves inherent risks, including, but not limited to, hiking, uneven terrain, wildlife, weather conditions, transportation, and use of photography equipment. I voluntarily assume all risks of injury, illness, property damage, or loss, including damage to or theft of my equipment or personal belongings.
Release of Liability: I release, waive, and discharge Photography Workshops of Utah, its employees, contractors, and affiliates (the “Organizer”) from any and all claims, liabilities, or causes of action arising from my participation in the workshop, whether caused by negligence or otherwise, including claims for personal injury, property damage, theft, or wrongful death.
Indemnification: I agree to indemnify and hold harmless the Organizer from any claims, damages, or expenses arising from my actions or participation in the Workshop.
Medical Treatment: I authorize the Organizer to seek medical treatment in case of injury, accident, or illness, and understand I am responsible for all costs.
Personal Property: I am solely responsible for my personal property, including cameras, lenses, and other equipment. The Organizer is not responsible for lost, stolen, or damaged items.
Governing Law: This agreement is governed by the laws of the State of Utah.
By checking the box below, I acknowledge that I have read, understand, and agree to this liability waiver and release. I understand that this means I am giving up certain legal rights, including the right to sue the Organizer.
☐ I have read, understand, and agree to the Ken Spurgin Photography Workshop Liability Waiver & Release.
For photographers who are traveling for workshops, I strongly recommend purchasing trip insurance to cover your costs in case of cancellation or withdrawal.
Single day Workshops Booking, Payment, and Deposit
I require full payment for 1-day workshops at the time of booking. If you cancel at any time, the deposit amount is non-refundable unless I am able to fill your spot before the workshop starts. Please note, refunds are subject to a 5% processing fee as credit card processors are no longer refunding their fees to me. Your entire registration fee is due and becomes non-refundable, we will move you to a future date for your single day workshop.
Rainy Day Policy
If it’s stormy or rainy, 9 times out of 10 we will still conduct the workshop. This is due to a number of reasons including the unpredictability of the weather, and the difficulties of rescheduling a large number of individuals. In addition many dramatic landscape and seascape images are captured during stormy weather due to the extra drama. I will never cancel a workshop based on the forecast unless the forecast calls for severe weather making the workshop unsafe. If the weather is deemed unsafe, I will strive to give as much lead time as possible before the workshop. I cannot offer refunds for a weather related cancelation, but I will offer credit towards a future workshop.
Under-Subscription
My workshops require a minimum of three participants. In the case of under-subscription I reserve the right to cancel the workshop, in which case your registration will be transferred to another workshop of your choosing.
